<p>Many would say Mukesh Ambani looks like a thief. And it turns out that he may indeed be one. The Krishna Godavari D6 Basin pricing seems to substantiate this.</p>
<p>Following set of letters by EAS Sarma (Please see below) by ex Energy Secretary indicates that there is sufficient prima facie evidence for Mukesh Ambani to be prosecuted. KG D6 scam comes across another mega scam where national resources are skimmed off.</p>
<p>It is pertinent to note that the upright EAS Sarma is Sambandhi to the redoubtable Dr Subramanian Swamy, someone who is fighting the scrouge of corruption &amp; its con-joint twin <a href="http://zoomindianmedia.posterous.com/quick-take-on-secularism-and-bharat">sickularism</a>.<span id="more-1406"></span></p>
<p>Mukesh Ambani it looks like subsidises pernicious ideology of sickularism, that accentuates identity politics, perpetuates vote banks &amp; obfuscates scrutiny/transparency, thereby directly enabling corruption, loot of national assets &amp; tax-payer. Bharat earlier paid heavy costs for the <em>Nagad Narayan</em> mindset of its big businessmen; <strong><a href="http://www.hindubooks.org/HinduPhe/the_civilizational_perspective/page22.htm">an Ahmedabad Hindu banker funded Aurangzeb to victory</a></strong>. The Radia tapes showed links of <a href="http://zoomindianmedia.wordpress.com/2010/11/20/mediagate/">barkha dutt</a>, ranjan bhattacharya, <a href="http://zoomindianmedia.wordpress.com/2011/02/14/ndtv-and-prannoy-roy-once-upon-a-time/">prannoy roy</a> to reliance, people that nurture <em>sickular subversion &#8211; totalitarian, imperial, predatory global beliefs backed by dogma and threats of coercive violence are good and nice while native Hinduism, an essentially decentralised faith, where experience is central, skepticism is integral, belief voluntary and text is subservient abused and smeared as intolerant.</em> Not surprisingly, a<a href="http://www.moneylife.in/article/media-ndtv-continues-to-find-buyers/16183.html"> reliance related entity took stakes in NDTV</a>. Earlier, <a href="http://www.outlookindia.com/article.aspx?268457">Reliance Lobbyist had cited</a> that they need to support Prannoy.</p>
<p>Clout of these people could be noticed from what is seen by some as successful efforts to take out Sanjaya Baru from editorship of Business Standard, the magazine that reported <a href="http://www.business-standard.com/india/search_news.php?search=%20E%20A%20S%20Sarma&amp;select=keyword">EAS Sarma&#8217;s letters</a>. Sanjaya Baru was someone with connections to PMO. Perhaps with the CAG report being released, Mukesh Ambani, Barkha Dutt types would have wanted to <em>manage</em> the media environment w/o Sanjaya Baru.</p>
<p>Letters below from Shri EAS Sarma highlight the oil scam. Can this nationalist with focus &amp; commitment to truth stop the loot? Can the Chief Justice S H Kapadia and team defang the charlatans that have become a law in themselves? Or will the vested sickular lobbies &#8211; Apni Dukan &#8211; CON party, its , friends in high places in left &#8211; CPM, NDA &#8211; sections of Dilli BJP (Ranjan etc), JD(U) and the international network of influence &#8211; CFA etc bail &#8216;Mukesh and friends&#8217; out? Does Narendrabhai have it in him to bell the sickular fat cats? Corrupt are a highly united lot and they have the resources to buy out those that are against them or do worse. India deserves nothing less than the complete defanging of the corrupt sickular lot.</p>

<p>The Chief Minister of Andhra Pradesh has rightly expressed his anguish at the way the Reliance Group of companies has been trying to dictate terms to the State Government in the matter of pricing natural gas from their offshore gas fields in Krishna Godavari basin.</p>
<p>The gas that is found onshore or offshore, whether it is by ONGC, Reliance or any other private company, is a natural resource that belongs to the people of this country. It is held in trust by the government on behalf of the people. The government is therefore not competent to dole out this precious resource to a private agency for making undue profit, under the guise of a production-sharing contract or any other means. The argument put forward by the Ministry of Petroleum recently that the Ministry has no role to play in the matter of pricing gas merely exposes the irresponsible manner in which the government has so far dealt with the induction of private players in the development of hydrocarbon resources of the country.</p>
<p>Anticipating the unethical moves of the private players, I had earlier written at least three letters, one to the then Petroleum Secretary on October 10, 2004, a second one to the Chief Minister of AP on May 4, 2006 and another letter to the Cabinet Secretary on December 19, 2006, cautioning them about the possible danger of Reliance and other companies exercising monopolistic power to fleece both the unsuspecting consumers and the respective State Governments. Despite these early warnings, the government has chosen to be a silent and passive spectator, allowing Reliance to have a free hand in pricing gas in whatever manner they wish to.</p>
<p>The world natural gas market is a highly fragmented one. Unlike in the case of crude oil and petroleum products, there is nothing that could be called the “market price” of gas at any given point of time. It is strange that Reliance should be allowed to devise its own method of  “discovering” by calling for tenders in a highly restricted sellers’ market and directing the State Government to pay them on par with the highest bid price for the gas to be used in power generation and in transport and domestic sectors. These very same bidders for the gas are those that have entered into highly asymmetric Power Purchase Agreements with the State electricity utility and they would in turn merely pass on the full cost of gas purchases to the State utility. In other words, the State Government would face the double jeopardy of bearing the high cost of electricity generation from private IPPs who have deliberately bid a high price for Reliance gas and also paying on par with that high gas price for utilizing the gas for supplies to domestic and other users. In fact, the State Government finds itself in such an awkward situation entirely as a result of the indifference, insensitivity and incompetence displayed by the Central Government in dealing, first with the design of the production sharing contracts and, second with the drafting of the latest Petroleum &amp; Natural Gas Regulatory Board Act of 2006!</p>
<p>I am not sure whether there is a grand design behind all this!</p>
<p>The Preamble of the above cited Act clearly refers to the need to “protect the interests of the consumers”. Section 11(a) of the Act reiterates this laudable concern. But, the Act itself is blissfully silent on the instrumentalities through which this concern would get addressed.</p>
<p>All the three consuming sectors, namely, power, transport and domestic sectors are such that it would be difficult for them to bear any undue cost burden, especially a cost burden arising from the rent-seeking opportunity handed over by the Central Government to private players. To permit the private gas producers in this country to charge a high rent on a natural resource defies all cannons of good economics. The Centre has done precious little to promote competition in the domestic gas market.</p>
<p>I would request the government to wake up to this reality at least now, amend the production contracts in public interest and ensure that the consuming sectors are not forced to pay anything more than the actual cost of development and an economically justifiable margin of profit, on the lines permitted by the regulators of electricity. The newly created Petroleum Regulator should be empowered to deal with the pricing of crude oil and natural gas in all its dimensions. There is also need to harmonise the petroleum and electricity regulation laws to bring sanity in the matter of pricing hydrocarbon fuels in tune with electricity price regulation.</p>
<p>I may mention here that the government’s response to this will be closely watched by the people at large. We had the unfortunate saga of Dhabol in Maharashtra. We do not want more Dhabols in the name of gas privatization!</p>

<p>Subject:- Pricing of Reliance Gas</p>
<p>I have enclosed below my last letter dated 30-6-09 on the subject for your ready reference.</p>
<p>I have come to know that the Reliance Group has already disclosed to the Director General of Hydrocarbons (DGH) the unit cost of production of natural gas from its fields in KG Basin to be around 80 to 90 cents per MMBTU. Such a disclosure is required under the terms of the Production Sharing Contract (PSC) entered into by the company with the government. I have separately requested the Director General of Hydrocarbons (DGH) to provide me accurate information on this under the provisions of the Right to Information Act, 2005. I have also requested the Cabinet Secretariat under the RTI Act to provide me the details of what had transpired at the meeting of the Group of Ministers (GOM) some time ago, when the GOM had recommended the price at $4.2 per MMBTU.</p>
<p>I presume that the Cabinet Secretariat that had processed the proposal of fixing the price of the KG Basin gas was in the know of the unit cost of production of the gas as available with DGH.</p>
<p>If the above information is correct, it raises several important issues regarding the intention underlying the decision of the government to fix the price of the gas at $4.2 per MMBTU.</p>
<p>Was it the intention of the government to permit the Reliance group to earn a return that is far in excess of what can be deemed to reasonable? On the total quantity of the gas expected to be produced and sold by the Reliance group from its KG Basin fields, a difference of $3.4 per MMBTU would imply billions of dollars of unearned profit for the company. Have the people of this country been informed about this?</p>
<p>As I had repeatedly been saying, the gas markets are highly fragmented and it is difficult to call any price a market driven one. The nearest one could get to this is the price offered by the Reliance group to NTPC in an internationally competitive bid format. The price on this basis worked out to $2.2 per MMBTU or so. I am sure that it is not the intention of the government to gag the voice of NTPC in this matter. If one were to adopt the price offered by Reliance to NTPC as the basis, the GOM-fixed price of $4.2 per MMBTU would still imply huge unearned profits for the company. The recent judgement of the Hon’ble Mumbai High Court corroborated this order of magnitude of the price.</p>
<p>Natural gas belongs to the people of this country and it is held in trust by the government and its statutory agencies. Its allocation and pricing should therefore be carried out in such a way that it serves the public interest. I am afraid that the government has not carried out the process of price fixation in a manner that is transparent to the public. The very fact that the government had earlier framed the Petroleum &amp; Natural Gas Regulatory Board Act of 2006 and precluded the regulator from the function of fixing the price of gas casts doubts on its intentions. The manner in which the political executive had taken over this power and determined the price at $4.2 per MMBTU has only corroborated these doubts.</p>
<p>I request the government to review the price and the allocation priorities for natural gas in general and for the Reliance gas from the KG Basin in particular in a manner that is reasonably transparent to the public. Otherwise, some of us may have to seek judicial intervention in the public interest.</p>
<p>I am confident that you will intervene in the matter urgently.</p>

<p>Subject: Pricing of Reliance Gas</p>
<p>This is in continuation of the series of letters I have addressed to you, the last one on 13-7-09. I am yet to receive an acknowledgement, leave alone a satisfactory response from the government on any of these letters!</p>
<p>I appreciate the hurried and somewhat belated attempt on the part of your government to declare that the natural gas resource found in the K.G. Basin is not the private property of the licensee and it is a resource held in trust by the government on behalf of the people of India. From what one learns from the news reports, the government has also filed an affidavit, though somewhat delayed, before the Hon’ble Supreme Court that it has the sovereign authority to determine the value and the priorities of allocation of natural gas. A family agreement that violates the sovereign authority of the government cannot survive. I hope the government will be able to argue these points emphatically before the Hon’ble Court.</p>
<p>While my RTI applications to Cabinet Secretariat and the Petroleum Ministry have so far drawn a blank, as I had already stated in my letter of July 13, 2009, RIL’s mandatory disclosure to DGH apparently shows the following:</p>
<p>i.  Total capital expenditure estimated till end 2009-10:   $4.8 billion</p>
<p>ii. Recoverable Reserves                                :   9.12 Trillion MMBTU</p>
<p>iii.Total “post well head” cost as indicated by RIL     :   $0.8945 per MMBTU</p>
<p>iv. Total “post well head” cost as per DGH’s<br />
interpretation (only operation expenditure from<br />
wellhead to delivery point to be included)              :   $0.2211 per MMBTU</p>
<p>(In these estimates, the interest on the cumulative expenditure on exploration &amp; development has been capitalized, assuming an annual interest rate of 14%. A lower interest rate would have been more appropriate! The unit cost then would be lower)</p>
<p>I am not sure whether the GOM had the benefit of having this information before it, while it arrived at the price of $4.20 per MMBTU! While the government may be anxious to maximize its royalty income by hiking up the gas price, it should know that every extra dollar of royalty will simultaneously give away more than a dollar extra profitability to RIL! Both royalty and the profit will adversely impact the consumers of electricity, the users of fertilizer and the households that use gas for cooking. These are the three large consuming sectors for gas. Indirectly, since these are sectors that cannot bear high tariffs, the additional cost will have to be borne by the government through subsidies.</p>
<p>In Rajya Sabha question No. 336, the Petroleum Minister informed the Parliament on 27-7-2009 that Reliance expects to invest $8.8 Billion on its KG fields to obtain a peak production of  80 MMSCMD of gas. The Petroleum Minister further informed the House that this figure stands validated by “independent” experts. This implies that RIL is going to claim a quantity equivalent to this investment as “cost” gas to be sold by them as their own share, in addition to the “profit” gas share they will be entitled to, as per the terms of the Production Sharing Contract. If RIL were to claim its entitlement of gas against $8.8 Billion investment, how long will the government have to wait till they start getting their own share of gas from the profits?</p>
<p>While a family agreement among the members of the Reliance Group should not be allowed to override the role of the government in gas pricing and allocation, I believe that the government should allow NTPC to protect its own commercial interests based on RIL’s bid to NTPC, keeping in view the real cost of gas from the KG field and the need to provide electricity to the consumers at affordable prices.</p>
<p>I understand that RIL is going to earn additional profits to the tune of one dollar per MMBTU for transporting the gas through its own pipeline to different consuming centres in western and northern parts. I had earlier cautioned the government to preempt this by asking GAIL to have exclusive rights over gas transportation. GAIL should have been brought into the picture fully by allowing that company to lay out a national gas grid to permit healthy competition among the gas suppliers. Unfortunately, my letters have evoked little or no response from your government.</p>
<p>I am afraid that the government has brought itself into a messy situation by not heeding to sane and timely advice. I wish the government had anticipated this situation, as cautioned by me several times in the past, and framed the Petroleum &amp; Natural Gas Regulatory Board Act of 2006 so as to empower the regulator to fix the gas price and the gas allocation priorities.</p>
<p>I hope the government, even at this stage, makes a public disclosure of all the financial and technical information on gas and allow a healthy debate to take place in the public interest.</p>

<p>Subject:- Special Audit of Implementation of Production Sharing Contracts with Oil &amp; Gas Exploration and Development Licensees in Krishns Godavari Basin</p>
<p>Dear Shri Rai,</p>
<p>I understand that C&amp;AG has taken up a special audit of the implementation of the Production Sharing Contract (PSC) between GOI &amp; RIL for gas exploration and development in Krishna Godavari Basin. I wish to bring to your notice certain important aspects that will indirectly impact the finances of the government, unless due care is taken to address them.</p>
<p>At the outset, I wish to point out that, despite my repeated advice to the Prime Minister and the Ministry of Petroleum &amp; Natural Gas (MOP&amp;NG), the latter had deliberately framed the Petroleum &amp; Natural Gas Regulatory Board Act of 2006 in such a manner that it would keep the petroleum regulator out of the domain of gas pricing. The stated rationale for this was that the price of gas would get “discovered” by the play of market forces, an assumption that had no basis whatsoever. Anyone familiar with the hydrocarbon industry would know that the gas markets the world over are highly fragmented and there is no alternative to adopting the “administered” pricing approach, based on the usual normative-cost-plus- reasonable-return approach.  This has resulted in the present unfortunate situation, virtually bestowing upon RIL and the other players, a monopolistic hold over the pricing of gas. Strangely, the same government that believed in the efficacy of the market forces made a volte-face and proceeded to appoint the so-called Empowered Group of Ministers (EGOM) to bestow upon the political executive the responsibility of fixing the price of gas! In other words, the government, knowingly or unknowingly, first disabled the statutory functionary viz. the petroleum regulator and then enabled the political executive to tinker with the price, for reasons best known to them.</p>
<p>In this connection, I enclose a copy of my latest letter dated 3-8-2009 addressed to the PM. The letter is self explanatory. It is beyond reason as to how the EGOM had fixed the price of gas at $4.20/ MMBTU, when RIL had quoted $2.34/MMBTU in response to an international bid floated by NTPC. If the government had ever believed in a competitive market, they should have straightaway adopted NTPC’s price as the benchmark. Instead, they waited, for reasons best known to them, for RIL to adopt a highly contrived exercise to determine the gas price and then adopted it as the basis.</p>
<p>I am not sure whether your office has all the relevant documents in this case. I have asked for the relevant information under the RTI Act but, so far, I have drawn a blank. RIL however seems to have made a mandatory disclosure of its costs vide its communication dated 22-5-09 addressed to DGH. According to this, the unit cost of production is $0.8945/ MMBTU. If the norms laid down by DGH were to be applied to this, the unit cost would further come down to $0.2211/ MMBTU.</p>
<p>It is facile for the government to hide behind the smokescreen of protecting or maximising its royalty income, when every extra dollar of royalty for the government will simultaneously yield more than that extra dollar to RIL in net profitability. The burden of both the profit and the royalty, along with the cost, will finally impinge upon the consumers of fertilizers, electricity and cooking gas, all of whom will seek subsidies from the government. The whole exercise of the government seems to tax the consumers and the tax payers of the country, only to provide more than reasonable profits to RIL!</p>
<p>I understand that the committee of officials that advised the EGOM had recommended gas price to be fixed at a lower level. C&amp;AG should perhaps obtain the relevant documents from the Cabinet Secretary. My own efforts to get the papers has so far met with resistance from the Cabinet Secretariat!</p>
<p>In para 102 of his latest Budget Speech, the Finance Minister has announced retrospective amendment of the Income Tax Act that will provide large benefits to the gas developers. Should the gas developers like RIL pass on this benefit to the consumers? The EGOM fixed price of $4.20/ MMBTU is a fixed one with perhaps some minor variation linked to crude price, whereas the tax benefit that will accrue to the developer is going to be fairly substantial.</p>
<p>In its communication dated 22-5-2009, RIL’s investment till the end of 2009-10 has been indicated at $4.8 billion, though in the reply to Parliament Question No.336, MOP&amp;NG has curiously revised this figure upwards to $8.8 billion. RIL seems to have capitalized the interest on investment at 14% which, to me, appears quite high. The investment estimates provided by RIL therefore need to be scrutinized carefully.</p>
<p>Mustang Engineering Company, one of the so-called &#8220;independent&#8221; evaluators of the investment estimates provided by RIL is apparently not that independent, as the company has since been appointed as RIL&#8217;s contractor in Panna development project. I have attached here a news report of 2008 for your information. The conflict-of-interest angle needs to be looked into in the case of both the independent evaluators in the case of RIL.</p>
<p>I get the sense that the way the government have proceeded on some of these concerns has not been transparent and straightforward. DGH, under Section 4 of the RTI Act, should have disclosed all this information in the public domain but they have failed to do it. I am not sure whether MOP&amp;NG has taken the Parliament into confidence fully.</p>
<p>While what I have said above referred to RIL, implementation of the other PSCs that MOP&amp;NG has entered into need to be subject to careful scrutiny so as to ensure that the public interest is fully safeguarded. All these concerns have far reaching consequences and their implications for the state exchequer can be enormous.</p>
<p>MOP&amp;NG has already started its preparations for launching NELP VIII auctions, without addressing the kind of concerns I have listed above. I enclose for your information a copy of my letter dated 8-8-2009 to Secretary (MOP&amp;NG) on this subject.<br />
I request C&amp;AG to look into these aspects as they have a far reaching public interest angle.</p>

<p>This is in continuation of my letter of August 3, 2009 on the concerns that have emerged on the pricing of natural gas from the fields licensed to RIL in the K.G. Basin. In view of the public interest implications, I wish to bring to your attention the additional concerns that have arisen.</p>
<p>I understand that the government has requested the Comptroller &amp; Auditor General (CAG) to audit the financial aspects of implementation of the Production Sharing Contract (PSC) in the instant case. It is a step in the right direction, provided the Ministry of Petroleum &amp; Natural Gas (MOP&amp;NG) and the other government departments extend their full cooperation to the high office of CAG.</p>
<p>The Director General of Hydrocarbons (DGH) has issued a statement through his website to give the impression that the capital expenditure details reported to have been incurred by RIL have since been audited by CAG, whereas CAG’s clarification on 11-8-09 (reported in local edition of The Hindu of 12-8-09) contradicts this by saying that any claim that such capital expenditure has been audited by CAG would “not be true to facts”. This casts serious doubts on the credibility of the agencies acting on behalf of MOP&amp;NG. Instead of making a public disclosure of the technical and financial information on all PSCs under Section 4 of the RTI Act, it looks as though MOP&amp;NG is trying to obfuscate the real issues to the detriment of the public interest. I doubt whether MOP&amp;NG has taken the Parliament into full confidence on such an important matter as this!</p>
<p>The case of NTPC in this RIL affair is important. NTPC should be allowed sufficient autonomy to safeguard its own commercial interests and the interests of its own consumers. Notwithstanding the statements made by the Minister in charge of MOP&amp;NG, I hope that the government will desist from any attempt to gag NTPC’s voice.</p>
<p>Anticipating the hurdles in the way of full disclosure, I had written a letter to CAG on 9-8-09 with a view to help that office to get at the kind of documentation that is relevant. I enclose a copy of that letter for your information.</p>
<p>Articles 149 &amp; 151 of the Constitution of India require the CAG to audit the accounts of the Union and the States and submit the audit reports to the Parliament. I hope that the Cabinet Secretariat and MOP&amp;NG will submit all the relevant record to CAG to facilitate a proper and meaningful audit of this deal.</p>
<p>The issues involved in these PSCs, especially the PSC signed with RIL, are such that they will significantly impact the finances of the Central government and affect the interests of the tax-payers and the consumers of natural gas. Your office has therefore a special responsibility to ensure transparency and accountability in this matter and take such decisions that will subserve the public interest.</p>
<p>I am afraid that MOP&amp;NG has not fully prepared itself for the new round of auctions in NELP VIII. I enclose a copy of my letter dated 8-8-09 addressed to Secretary, MOP&amp;NG on this subject. If the Ministry goes ahead with NELP VII without addressing the kind of concerns raised by me, the government will, no doubt, get itself into a situation as sticky as in the instant case.</p>

<p><strong>Subject: </strong>Natural Gas Pricing—Latest orders of the Hon&#8217;ble Supreme Court</p>
<p>I am happy that the Hon&#8217;ble Supreme Court has ruled unambiguously that the Production Sharing Contract (PSC) with private parties cannot override the inalienable right of the State and the people of the country to the natural gas resources that belong to them.</p>
<p>As reported in the press, it is significant that the Hon&#8217;ble Supreme Court has also made the following landmark observation.</p>
<p>&#8220;It is the duty of the Union to make sure that these resources are used for the benefit of the citizens of this country. Due to shortage of funds and technical knowhow, the government has privatised such activities through the mechanism provided under the production sharing contract. It would have been ideal for the Public Sector Undertakings (PSUs) to handle such projects exclusively.&#8221;</p>
<p>Against this background, I wish to impress upon the government that the Central government cannot, in the wake of the latest Court ruling, abandon its own obligation to exercise due diligence and prudence in fixing the price of gas, determine the sectoral and regional allocations and take all such measures necessary to prevent the supplier from exercising monopolistic leverage to the detriment of the public interest.</p>
<p>In this connection, I enclose here a copy of the detailed letter dated 22 August 2009 I had written to you on these very same issues that continued to be relevant even after the latest Court order.</p>
<p>The price fixed by the Empowered Group of Ministers (EGoM) is based on a contrived bidding format that was more beneficial to RIL than the public. The present arrangement of the EGoM administratively fixing theprice goes against all canons of competitive price fixation. The EGoM had, before it, the details of the price quoted by the supplier in a global competitive bid floated by NTPC. It was around $2.34 per million metric British thermal unit (mmBtu). Ignoring that price in favour of the priceobtained by RIL through a procedure that would fail to stand the test of good competition, the EGoM adopted a non-transparent process to accept the price indicated by RIL, raising questions of propriety.</p>
<p>When I requested both the ministry of petroleum and the Cabinet secretariat to provide me copies of the EGoM proceedings under the RTI Act, the government chose to cite &#8220;confidentiality&#8221; as an excuse and deny me the same. (Perhaps, the latest move on the part of the government to amend the RTI Act to preclude Cabinet proceedings from the public is a sequel to this, to keep such crucial decisions from public knowledge!)</p>
<p>I request the government to review the price fixed for the Krishna Godavari (KG) Basin natural gas in such a manner that the price is in the public interest. The mechanism of pricing should not be politicised. Instead, it should be entrusted to a statutory authority like the petroleum regulator, as already envisaged in the PSC itself. The government should also carry out an economic evaluation to arrive at the sectoral allocation priorities for natural gas, as suggested in my earlier letter.</p>
<p>I may mention in this connection that gas development is known to cause land subsidence. In the case of KG Basin gas, the ministry of environment had conveniently bypassed evaluating this aspect while according environment clearance to RIL. Some concerned citizens had to approach the Hon&#8217;ble Andhra Pradesh (AP) High Court to intervene and order a fresh environment appraisal of the project. The KG Basin comprises the heartland of agriculture of Andhra Pradesh and if there is land subsidence in that basin, it will break the backbone of the state&#8217;s economy. The state and the Central governments are oblivious, indifferent and perhaps insensitive to this impending calamity that is waiting to happen.</p>
<p>I hope that the government does not allow itself to be pressurised by the private company to overlook the public interest involved in KG Basin gas development.</p>

<p>This post examines some similarities between <strong>Islam </strong>and<strong> MS DOS </strong>and between Bill Gates and Mohummad. Most of the observations also apply for the other desert faith and its idols &#8211; christianity, jesus and bible.</p>
<p>This OS/religion comparison is not far fetched. Imagine the OS as the religious platform &#8211; in case of islam, koran, seerah represent the OS kernel though claimed immutable. Applications that sit on Operating System are analogous to socio cultural norms such as family values, fine arts, science, justice et. al.<span id="more-737"></span></p>
<p><strong>Introduction</strong></p>
<p><strong>Bill </strong><strong>Gates </strong>boot-strapped <strong>Microsoft&#8217;s</strong> business  by selling  MS DOS Operating System to change the world and Mohummad  bootstrapped his prophethood career by propagating his wares in the name of God to change the world.</p>
<p>When MS DOS (Disk Operating System) was written, it was certainly not the best operating system. There were technically superior operating systems available in the market.</p>
<p>Similarly when Koran was written, it was by distance not the best book in the world even in the western world where <strong>Islam</strong> was born. There were  very many better books that proferred superior worldviews. One could think of off hand Marcus Aurelius Antonius&#8217;s  <a href="http://classics.mit.edu/Antoninus/meditations.html">Meditations </a> and Plato&#8217;s <a href="http://classics.mit.edu/Browse/browse-Plato.html">Dialogues</a>. These works Meditations and Dialogues are sublime and are superior to what Mohummad and his followers compiled as Koran. <em>(One may want to validate this by reading objectively and critically both Koran and Marcus&#8217;s Meditations)</em></p>
<p>{Let us not focus here on the wonderful and older conceptualizations carried out by Indian seers acknowledged as such subsequently by unbiased muslim scholars &#8211; conceptualizations such as <em>Brahma Sutr &#8211; Secret of God, Yoga Sutr &#8211; Techniques for Realizing God or Bhakthi Sutr &#8211; Techniques and Secrets of Devotion to God</em> or efforts further to the east by the Chinese scholars (Lao Tse, Confucius etc.)}</p>
<p>DOS was not something original written by <strong>Bill </strong><strong>Gates</strong>. The &#8220;Microsoft Disk Operating System&#8221; or MS-DOS was based on QDOS, the &#8220;Quick and Dirty Operating System&#8221; written by Tim Paterson of Seattle Computer Products, for their prototype Intel 8086 based computer. Similarly Monotheism was not something original to Mohummad.  Jews and Christians knew Monotheism;  Zarathushtra, many sects in ancient Egypt and in India had believed in different forms of Monotheism.</p>
<p>Koran was an output based on tales, essentially Rabbanic that Mohummad <em>heard</em> from travelers and intellectuals during the business travels that Mohummad made when he was employed by Lady Khwadja, a Mecca based rich widow and a businesswoman. Many insightful commentators have highlighted that Mohummad&#8217;s interpretations of Rabbanic tales have tended to be self serving. And not surprisingly koran is contextual to its environment &#8211; middle east in medieval times.</p>
<p>It can be argued that both MS-DOS and islam benefited their first adherents though both were sub-optimal solutions.</p>
<p><strong>Reasons for Success in Market &#8211; Women behind Men<br />
</strong></p>
<p><strong>Bill </strong><strong>Gates</strong> succeeded because <strong>Bill </strong><strong>Gates&#8217;s</strong> mother Mary Gates had served with John Akers, IBM Director and later CEO, which was instrumental in <strong>Bill </strong><strong>Gates</strong> getting the contract for installing DOS for IBM PC. The IBM PC contract bootstrapped <strong>Microsoft&#8217;s</strong> growth.</p>
<p>Mohummad succeeded because Khwadja (a leading business woman of Arabia and from dominant Quresh tribe in Mecca) provided Mohummad, a semi-literate orphan 15 years her junior employment and subsequently her spouseship providing orphan Mohummad enhanced status in Mecca and among Quresh.  As an aside,<em> some scholars critical of islam</em> have argued that <strong>Islam&#8217;s</strong> subsequent subjugation of women was in response to the psychological impotence that Mohammad may have felt and the complexes Mohummad developed as a result of his orphanhood and dependency on Khwadja who comes across as a dominant personality.</p>
<p>It is important to understand why both Bill Gates and Mohummad succeeded. The Primary Reason; Effective dissemination of their products &#8211; DOS and Koran both of which succeeded despite their not being the best of products in the market when they were conceptualized.</p>
<p>Unlike Apple the OS that MS DOS 1st competed with, DOS was licensed to every computer manufacturer at a cost effective price. Hence Apple OS, though it was qualitatively better OS could not match the economies that MS-DOS&#8217;s horizontal model spawned and gradually the vertical business model that Apple (competition) operated on collapsed.</p>
<p>In case of disseminating Koran, Mohummad did not face significant competition at all from an intellectual context. The Roman Empire had fallen and the rigidity of Church had taken over as dominant paradigm across much of Europe and middle east. Middle eastern world had entered dark ages. Islamic ideology took birth in an environment that was full of hatred, intolerance and war mongering. Conceptualization and propagation of Koran happened at a time when distances were not easily covered and proliferation of knowledge of limited. Not many people including Mohummad would have heard or studied Plato&#8217;s and Marcus&#8217;s classics. Simplistic certitude coupled with the possibility of making war booty in the initial years helped recruitment; initial recruits to islam were mostly have-nots that noticed the potential to gain materially. God was used as the dogmatic bogeyman to enforce order among tribes. And Islam took off.</p>
<p><strong>Impact of Bill Gates and Impact of Mohummad</strong></p>
<p>Everyone knows the impact that <strong>DoS</strong> and Koran have had on our lives. <strong>Microsoft</strong> has been ruthless in the market thorough their Monopoly based practices. Among other actions, bundling of Explorer to destroy Netscape Navigator is old History. Through the 1990s, Microsoft&#8217;s mis-representative trade practices and under-hand methods were criticized. With the Internet itself becoming the platform, even Bill Gates could not completely control the industry. Propoganda myth creation citing selective charity work by the <a href="http://2ndlook.wordpress.com/2010/11/22/people-for-profit-the-ngo-story/" target="_self">NGOs</a> and the likes of Bill Gates go on though there is ample evidence on how he treated Microsoft co-founder Paul Allen when Allen was diagonized with cancer (he explored ways to dilute co-founder&#8217;s equity <a href="http://www.dailymail.co.uk/news/article-1371608/Bill-Gates-tried-cut-Paul-Allen-Microsoft-fell-ill-cancer.html">Link 1</a>, <a href="http://www.vanityfair.com/business/features/2011/05/paul-allen-201105?currentPage=all">Link 2</a>) and is majorly funding propagation of questionable initiatives like the GMF (Genetically Modified Food) using among other things, spurious right to choice canard. These days, Bill Gates is claiming to support health-care. There are reports of his foundation involved in short changing <a href="http://www.independent.co.uk/news/world/asia/without-consent-how-drugs-companies-exploit-indian-guinea-pigs-6261919.html">gullible Hindu tribals in India through dubiously conducted drug trials</a>. His legacy is still work-in-progress.</p>
<p><strong>Islam</strong> and Koran have been if anything even more ruthless than Microsoft&#8217;s practices. There is no tolerance of dissent to the extent that anyone that questions Koran or Mohummad even remotely faces Blasphemy laws and is punishable by death according to Shariah (Islamic Jurispudence). Mohummad&#8217;s islam remains an influential paradigm though it faces the challenge of <em>Kaal</em> (time induced changes). Koranic certitudes have faced challenges in the light of women&#8217;s empowerment and inability to<em> respect</em> those who reject the ideology of <strong>Islam</strong>. The continuing difficulty of Muslims to adjust as a minority people; the creation of Pakistan, large scale support for Hudood, the continuing Jehad in Kashmir, Medieval Behavior of Taliban are manifestations of these challenges.</p>
<p><strong>Conclusion</strong></p>
<p>Apple Macintosh OS, much superior to DOS, lost out to it. In an environment of information and knowledge distortion, inferior products backed by superior propaganda, penetration techniques (including deceit) and promising of adequate economic reward do tend to succeed. Regulator&#8217;s job should be to minimize possibilities for information and knowledge distortions.</p>
<p>George Orwell&#8217;s big brother did not die out. Its various shades live with us as islamic and christian dogmas. For example islamic belief is predicated in conditioning the mind through repetitive &#8216;dogmatic&#8217; assertions. One Size (koran, sunna in case of islam, jesus&#8217;s personality in case of christianity) fits all assertion backed by centuries of propaganda. Dogma based certitudes such as islam, christianity do not reflect the majesticity and complexity of nature, creation and life.</p>
<p>As distinct from simplistic dogma monochromatic weltanschuang in totalitaran world-views like that of  islam and christianity, Hindu Dharma Point of view asserts, that differences are inherent in nature. Experiences and not dogma form the basis for religious beliefs. Skepticism, Critical Examining are encouraged. Through the Law of Karma people are made responsible for their actions. Feminine as manifestation of divine is accepted. Hinduism urges that change is an inherent part of the fabric of reality of the Cosmos and evolution. Plants, animals, and seasons &#8211; everything have their differences and and built-in cycles integrated to them. Differences are built into the way human beings are composed &#8211; in their bodies and minds and their cultures and languages.</p>
<p>It has been proposed that for beliefs like islam and christianity to be meaningful, they should be reinterpreted. Many assert that these beliefs do not lend to reinterpretation and that both these dogmas should be effaced; that secularism should be applied on them; In any case, it is important to realize that knowledge distortion that happens on account of uncritical dogmas, end up doing damage to humanity.</p>

<p><span id="more-1161"></span>There is this new anomaly that is crystallizing in the wake of BJP&#8217;s election loss in 2009. This anomaly is <em>essentially is a manifestation of half baked and ignorant efforts to describe India&#8217;s problems and suggest prescriptions that are not rooted in native realities</em>.  Many of the people shaping the anomaly define themselves  based on western frame works &#8211; as right of center or conservative or or classical liberal, libertarian etc. Others would tend to call them as Sickular Right or HINO (Hindu in Name Only) or BINO (Bharatiya in Name Only) or IBCDs (Indian Born Confused Desis) or simply confused desis. Let us define these people and the anomalous positions they are projecting as <strong>Secular right</strong>, for convenience and also because  many of them seem to have discomfort asserting their native identity in public space or tend to believe that identities are best kept at home. Cunning among them some times wear a native facade exceedingly well (<em>Mein Bi Hindu Hoon Deceit</em>), but the mask slips as you learn their positions on substantive issues.</p>
<p>Secular-right position is manifested essentially by people who notice the reality that CON party sucks big time; and believe that Governance in India is abysmal. But these people though are not equipped well to understand the native narrative and that solutions rooted in native assertion are best placed to take India out of its institutionally corrupt sickular morass. Secular- right kind of anomalies that are poorly rooted in native realities tend to result in injecting <em>Vishama</em> to the discourse, just as porting nehruvian permit-license marxist cronyism and <a href="http://zoomindianmedia.wordpress.com/2009/10/19/indian-secularism-is-sick/">sickularism</a> on India did. Ignorance coupled with arrogance is a failure recipe. Such positions by their very nature are anarchic.</p>
<p>The secular-right  anomaly different shades some of which are an outcome of subversion of India&#8217;s education system and of national narrative &amp; national discourse done by British, and even more vehemently done subsequently by CON party sickos particularly note worthy of who was Nurul-Hasan, Human Resources Minister during Indira Gandhi&#8217;s term as PM. Certain shades of secular-right anomaly are also an outcome of people that have just had a monochromatic exposure to the west &#8211; reading works by the likes of Adam Smith and Fredrich Hayek but unfortunately not reading <em>Anushasan Parv</em> or the <em>Nitis</em> &amp; <em>Smritis</em> from <em><strong>native </strong></em>sources; many tend to carry covert and overt disdain for native sanskaras and traditions.</p>
<p>Secular Right people because of their confused understanding have had a serious difficulty offering a coherent political paradigm to replace the failed sickular-cronyist narrative presented by Congress Party and Communists. Congress Party and Communists have monopolized the levers of discourse because of institutionalized support funded among others by the tax-payer and have sought to push their self serving canards as national narrative; Various shades of the failed sickular-cronyist narratives have tended to define themselves today as liberalism, progressivism, ummah socialism, liberation theology etc. The cunning ones among them, injecting <em>Vishama</em>, not suprisingly, have deployed native sounding names like <em>Nalanda </em>etc for their subversive initiatives.</p>
<p>Normative secular right people end up following the western conservative prescriptions. Most dont realize that the <a href="http://2ndlook.wordpress.com/2010/11/22/people-for-profit-the-ngo-story/">liberalist west</a>, <a href="http://www.politicsdaily.com/2011/02/16/the-case-for-conservatism-versus-libertarianism/">conservative west</a>, <a href="http://zoomindianmedia.wordpress.com/2009/10/19/indian-secularism-is-sick/">secular west</a>, <a href="http://mises.org/daily/2014">libertarian west</a> were contextual to christian west and conjoin through the entity of church. Among the secular right people, a small minority find attractive paradigms offered by Hindutva-waadis &#8211; Savarkar, Hedgewar (Sangh Parivar) and the ones by Vivekananda (Narendranath), Ambedkar who all had social views that were not exactly dissimilar. This need not surprise, because many of Savarkar/Ambedkar views were rooted in a western reference frame. Their understanding of <a href="http://www.dnaindia.com/opinion/column_caste-as-social-capital_1387350">jati-varna systems</a> was less than optimal and tended to be monochromatic and hostile. Dr. Hedgewar, it must be remembered too was associated with Dr Moonje, Savarkar and had links to Congress Party. Dr. Hedgewar and particularly Madhav Rao Golwalkar were also intimately connected to neo-vedantic initiatives by the likes of Vivekananda; BR Ambedkar turned to <em>neo</em>-buddhism.</p>
<p>This post highlights a remarkable effort at defining a native paradigm and specifically the dialog that took place between someone who takes what can be called a secular right position and person that takes Bharatiya Position rooted in native realities. Blogger Anuraag Sanghi has modeled an elaborate <strong><a href="http://2ndlook.wordpress.com/2010/09/06/bharat-tantra-prequel-to-modern-history/">frame-work Bharat Tantra</a></strong>. And Anuraag&#8217;s blogpost generated a heated exchange between <strong>Jindal (Secular Right certitudes),  Incognito (Bharatiya) </strong>which is the subject of this blogpost and captured below. Jindal ends up showing typical &#8216;holier than thou&#8217; behavior and ends up getting chastened each time. He still does not give up. There were some other interesting comments too which are reproduced below. In the interests of brevity and relevance, some of the comments were edited and some of the comments in the original thread omitted.</p>

<p>The Indian subcontinent has given undue importance to religion and hence deep fault lines like the partition among others exist today. In comparison, China and Europe are a lot more homogenous. The entire Indian subcontinent should wash off religious tendencies. Instead of dwelling on the past and singing glories of the past (like losers – even Pakis think they as in “Muslims” [not mughals] ruled India for a thousand years – it is also in their textbooks), every Indian should think like a winner and learn to live in the present, and invent for tomorrow.</p>

<p>There is no reference to jati in the scriptures. Devolving from interpretations of varna, these were inventions added by some latter brahmins which resulted into a hybrid caste-profession ideology as jatis. This was perhaps to retain monopoly over Hindu society in the name of preserving bloodlines. To give you a sampler of twisted sharia like punishments recommended by the dubious brahmin writers of such laws was to pour molten red hot iron in the throats of untouchables for the crime of trying to be pious!!!</p>
<p>Genetically speaking, there are very minor variations of the Haplogroup R1a Y-DNA within all reaches of Indian ethnicities regardless of caste or the fictitious Aryan/Dravidian racial divide. All are swastika carrying south-asian caucasoids. There is no basis (scientific or philosophical) for the concept of a birth-based jati or varna per se. If varna or jati were to be interpreted as ‘profession’ based on one’s intellect and education, such a system has existed everywhere since time immemorial, and can’t be removed anywhere even if we wanted to.</p>
<p>As for the evolving master-slave bi-colored landscape based on class system that you mention, I’d say it’s gray-scale and not all that black-and-white. A capitalist system has existed through various civilizations and as long as it remains, there will be rich and poor. After having felt the urge to free themselves from suppression of individual freedoms in other countries, people turn to the United States from all over the world to be able to exercise rights granted by the constitution. <p>My neighbor is a government officer, wife is a trader, daughter an economist, and son a mechanic. And so is the case with a dozen other neighbors. No relation between occupations of members in a family. As I’ve pointed out earlier, the backward system you profess has problems — someone born in a supposedly high caste is likely to reserve the right to follow “father’s profession” (given that mom would be in a veil restricted to the kitchen), despite that person lacking aptitude, intelligence, and education. In a nutshell, say a person is born in a high caste family but has an IQ of a shoemaker, I do not recommend that he work on nuclear engineering — it would a disaster to mankind.</p>
<p>I have been suspect of the declining quality of Indian education. For instance, I have observed a trend – India’s new gen is becoming more literate but in general lacks world class comprehension and analysis skills. That’s disturbing given where India’s neighbor is headed with education:<br />

Note that most systems in existence today are a blend of various systems.</p>

<p><strong>During 1997 and 1998, the names of NDTV and its founder Prannoy Roy appear in newspapers and magazines in relation to a major corruption case in Doordarshan.<span id="more-1219"></span></strong></p>
<p>In the context of the recent <a href="http://www.sunday-guardian.com/a/1082">reports of financial malpractice</a> by NDTV and its founder Prannoy Roy, I followed up on this tweet by Kunal Majumdar, a journalist:</p>
<blockquote><p>In 1998 CBI had filed a case against Pranoy Roy for creating a loss of Rs 5 cr to DD <a href="http://www.indianexpress.com/ie/daily/19980120/02051164.html" target="_blank">http://bit.ly/ij5lC3</a> #fb</p></blockquote>
<p>I was surprised to learn of the existence of a CBI case against Prannoy Roy. I wanted to dig up more on this story. I went through <a href="http://www.google.co.in/search?sourceid=chrome&amp;ie=UTF-8&amp;q=prannoy+roy+cbi+dd">all 16 pages</a> returned by Google for “prannoy roy cbi dd” and found many interesting links. I’m putting the links here quoting revelant portions of the articles. One must be cautious before drawing conclusions from these articles as they were written more than a decade ago. But one conclusion that people may safely draw is that during the early 90s, NDTV and its founder and Executive Chairperson Prannoy Roy were allegedly involved in corrupt dealings reportedly causing a loss of atleast Rs. 3.52 crore to Doordarshan, allegedly bribed an official in the Government of India, and in <strong>January 1998 cases were filed against Roy and others by the Central Bureau of Investigation (CBI) under Section 120-B of the Indian Penal Code (IPC) for criminal conspiracy and under the Prevention of Corruption Act</strong>.</p>
<p><a href="http://www.outlookindia.com/printarticle.aspx?204133">Outlook, 1st September 1997</a>: <strong>“Star Crossed | Star TV boss Rathikant Basu tries desperately to save his job as the CBI gets ready to file cases against him”</strong></p>
<blockquote><p>It’s not just Basu who is under the CBI searchlight. Agency records name NDTV CEO Prannoy Roy as a beneficiary and the CBI is currently firming its case against him. Says V. Lakshmi Ratan, additional secretary, DOPT: <strong>“The case will be against both the bribe-giver and taker. Roy will definitely be in the CBI dragnet if the agency finds evidence against Basu.</strong>” And the CBI’s blotter of charges—though not new—can be potentially very damaging.</p>
<p>At present, the agency is looking into two allegations: that in 1990, Basu as director general, Doordarshan, took the arbitrary decision to place a news-programme, The World This Week—produced by Prannoy Roy’s NDTV—in the ‘A’ category for the purposes of sponsorship and in the ‘A Special’ category for spot buys. This decision, according to this year’s annual Public Accounts Committee (PAC) report, cost the exchequer a whopping Rs 3.52 crore.</p>

<p>The situation gets hairier for Basu since legal experts within the agency are almost unanimous that Basu’s employment with Star TV—which, incidentally, has a tie-up with NDTV—on what is said to be a whopping monthly salary of Rs 15 lakh only three days after he left government service, establishes the fact that he was a beneficiary.</p></blockquote>
<p>The original motivation for the CBI inquiry seems to be bureaucrat scrutiny at wrongdoing by  Roy and Basu though sections of media appeared to project it differently.</p>
<p><a href="http://www.outlookindia.com/printarticle.aspx?204285">Outlook, 22nd Sep 1997</a>: <strong>“How Zee Is Shooting Star: Lobbyists have a field day as Subhash Chandra guns for partner Murdoch’s expansion plans”</strong></p>
<blockquote><p>Surely, our culture and democracy couldn’t be so feeble. Hence the government seems to have adopted a more legalistic means to stop Star TV in its tracks. They’ve picked on Basu, once the government’s favourite bureaucrat, today the bad boy of babudom who’s sold out to Murdoch the marauder. Peer envy? Some elements in the bureaucracy agree. It is pointed out that when the DTH ban notification was issued, Basu, accompanied by Prannoy Roy and Rajat Sharma, had rushed to the prime minister who, in turn, had hauled up three senior bureaucrats—cabinet secretary T.S.R. Subramaniam, telecom secretary V.K. Gokak and the then information and broadcasting secretary N.P. Nawani—for issuing a sensitive order without consulting the PMO. That got the bureaucracy’s goat and the ministry of personnel and the CBI were asked to fix Basu for good.</p>
<p>Every available missile has since been fired at the Star TV India CEO—the rule book, an ultimatum to remit office within 15 days, the threat to set the CBI on his trail. It did spread panic—Gary Davey flew down to Delhi twice, Murdoch flew into Hong Kong to take stock and Star’s ally, Prannoy Roy’s NDTV, faced the prospect of being sucked into the vortex of the raging controversy—but, as things stand, Basu is still in the saddle and fighting. The case against him is that as a former DD chief, he is privy to the national broadcaster’s long-term plans. But one has to be spectacularly gullible to swallow that line: the only secrets that DD can possibly yield for the benefit of its rivals would be about how not to run a network. It is, after all, a badly-managed outfit whose policies have less to do with market realities and its public service broadcasting aims than with the whims of its political bosses in Shastri Bhavan.</p></blockquote>
<p><a href="http://www.indianexpress.com/ie/daily/19980120/02051164.html">Indian Express, 20th Jan 1998</a>: <strong>CBI case against Prannoy Roy</strong></p>
<blockquote><p>The Central Bureau of Investigation (CBI) has filed a case of criminal conspiracy against New Delhi Television (NDTV) managing director Prannoy Roy, former Director General of Doordarshan and present Chief Executive Officer of Star TV R Basu and and five other top officials of Doordarshan. The First Information Report (FIR) filed on the basis of “source information”‘ says that the undue favour granted to Prannoy Roy had led to a loss of approximately Rs five crore to Doordarshan.</p>
<p>The FIR filed in the court of Special CBI judge Ajit Bharihoke alleges that the officials of Doordarshan had “entered into a criminal conspiracy at New Delhi during 1990-1996 with Prannoy Roy with a view to cause favour by abusing their official position.”</p>
<p>According to the CBI charge-sheet, DD suffered a loss of over Rs 3.52 crore due to the “undue favours” shown to NDTV as its programme The World This Week (TWTW) was put in `A’ category instead of `special A’ category.</p></blockquote>
<p>The case filed was specific. Not much is known about the fate of the CBI case. While the Indian Express report says that a case was indeed filed against Prannoy Roy, NDTV’s public offering prospectus in 2004 seemingly falsifies this information and implies that there was no FIR or no case was filed against NDTV or Roy:</p>
<blockquote><p>The Company and its promoters have also been named in an First Information Report (FIR) filed by the Central Bureau of Investigation (CBI) in January 1998 against certain DD officials in relation to certain violations of rules by DD officials pertaining to certain programmes produced by the Company for telecast by DD. Till date, no case has been instituted against the Company based on the investigation carried out pursuant to the FIR.</p></blockquote>
<p>In March 1998, Smt Sushma Swaraj took over as Information &amp; Broadcasting Minister in AB Vajpayee&#8217;s cabinet. This was what was last heard.</p>

<blockquote><p>Another wrongstreet the government is getting into is going after Murdoch through Prannoy Roy and R Basu. Sushma Swaraj has said that she is letting loose the CBI to look into the undue benefits provided to NDTV by DD when he used to provide the state network with programming. An issue that has been simmering for the past couple of years but has got nowhere. It’s about time, the authorities stop their tomfoolery and get over their Murdoch fixation.</p></blockquote>
<p>Here’s some kind of “list of events” related to DD from 1998: <a href="http://www.screenindia.com/old/dec25/tele2.htm">Doordarshan: The Year That Was!</a> It seems to have been in memory as late as 2003, as shown in this <a href="http://www.rediff.com/news/mar/03buzz.htm">gossip article</a> at Rediff from March 2003:</p>

<p>Despite the recent public focus on the misuse of ministerial discretion, nothing seems to have changed. A case in point is the information and broadcasting ministry.</p>
<p>In the recent past, Doordarshan has turned many including Prannoy Roy to Vinod Dua into millionaires. And many more constantly knock at its doors for make-me-rich-overnight contracts, especially where commissioned programmes are concerned.</p></blockquote>
<p>[Editor: The whole saga turns up several interesting points. Who bailed Prannoy Roy and NDTV out? Needle of suspicion points at the following people in the NDA Government: AB Vajpayee, PM, Brajesh Mishra, Cabinet Secretary, LK Advani, Home Minister and Sushma Swaraj, Information &amp; Broadcast Minister. The decision could have been a consensual one driven by Brajesh Mishra. One does notice that Brajesh finds himself in NDTV whenever he wants. AB Vajpayee to NDTV was always the good man in a bad party. NDTV's coverage on Smt Swaraj is markedly different from its coverage of Shri Narendra Modi.  Before 2009 elections, LK Advani was specially awarded by NDTV for life time achievement (<em>for what? babri mosque structure demolition? <img src='http://s1.wp.com/wp-includes/images/smilies/icon_wink.gif' alt=';-)' class='wp-smiley' /> </em>).</p>
<p>Progressively in Indian media, journalism of courage has by and large been buried. Prannoy James Roy, son of English Mother and Bengali father has done rather well by networking with the powerful and the corrupt. He is a member of the CFR. He is a co-brother of Prakash Karat, Marxist Communist Party, General Secretary who by the way is also a <a href="http://www.hindustantimes.com/StoryPage/Print/697629.aspx">bible expert and who was guided by liberation theologian, Reverend Duncan Forester for scholarship to Edinburgh University</a> (Wikipedia wont tell you this. <img src='http://s1.wp.com/wp-includes/images/smilies/icon_wink.gif' alt=';-)' class='wp-smiley' />  ) Prannoy is Suzanne (aka Arundati) Roy's cousin. By and large and not surprisingly NDTV has been faithful to red and islamist networks whose agenda, NDTV champions. Discourse subversion by the likes of NDTV has high costs and is not understood by many. One shudders to think to what compromises, NDTV and the Roys would have done to sustain their almost perpetually loss-making entity. Continuous survival of a continually loss making NDTV is a financial miracle in itself that calls for scrutiny.</p>
<p>Further, success through corruption sets a very wrong example to the society. Its not a coincidence that Rajdeep Sardesai, Raghav Behl and others have sought to emulate Prannoy Roy Model of Corruption and Deceit journalism. It is said old habits die hard. NDTV was again in the news for corruption. Sunday Guardian highlighted how <a href="http://www.sunday-guardian.com/a/1088">NDTV avoids Taxes</a> and of <a href="http://www.sunday-guardian.com/a/1082">financial chicanery with ICICI bank</a>. NDTV decided to brazen it out and <a href="http://www.sunday-guardian.com/a/1083" target="_blank">tried intimidating tactics</a> with Sunday Guardian. And well, interview appearances, 'awards' for <a href="http://is.gd/iecgZ" target="_blank">Chanda Kochchar</a>, '<a href="http://www.icicibank.com/aboutus/awards-08.html" target="_blank">Life time Achievement' for KV Kamath <img src='http://s1.wp.com/wp-includes/images/smilies/icon_wink.gif' alt=';-)' class='wp-smiley' />  and award to ICICI</a> have nothing to do with quid pro quo?</p>
<p>Fredrick Hayek's rule on people violating ossified rules in India kind of scarcity environment has been proffered at times to justify corruption. That defence does not hold in cases similar to prannoy roy's CBI case where the goal is to defraud the tax-payer and criminal conspiracy is involved. It might be worthwhile for intrepid RTI -waalas to cull out facts on Prannoy Roy's CBI case. Dr. Swamy suggests innovative ways to <a href="http://zoomindianmedia.wordpress.com/2011/02/06/corporate-corruption-dr-swamy/" target="_blank">prosecute the corrupt</a>. These approaches are likely to work when the judiciary is fair. Judiciary, post KG Balakrishnan seems different and presents a window of opportunity to tame corruption such as NDTV's]</p>

<p><em>Janata Party President and Harvard University Professor on Economics, Shri Subramanian Swamy addresses an Indian audience on widespread corruption. His lecture was also followed by interactive Question and Answer Session. The quality of question and answers are far superior to the pantomime charades, using carefully selected audience, carried out by the sicko agenda peddlers &#8211; NDTV, Barkha Dutt etc in megalomaniacal &#8216;we the people&#8217;, IBN, sagarika ghose &#8216;face the nation etc&#8217;. Sicko Media of course fools around and provides hyper cum  sanitized coverage on primed audience adulating CON party&#8217;s<a href="http://www.youtube.com/watch?v=wNJDUor6AFw"> Rahul Gand and censors what Indians really think of him</a>. </em></p>
<p><em>Dr. Swamy has been organizing such meets across India. Unfortunately Indian Media which itself is known for its low ethical standards hardly provides commensurate coverage. Dr. Swamy makes Important points. Those that care for India should listen. </em></p>

<p><strong><span style="text-decoration:underline;">TRANSCRIPT</span></strong></p>
<p>There is an Epidemic of Corruption today. One has to get to the root of the matter and eliminate it there. There was a time culture of this country was known by three beautiful words: S<em>atyam, Shivam, Sundaram</em>. In my recent book  <strong>Corruption and Corporate Governance in India</strong> (<a href="http://www.amazon.com/Corruption-Corporate-Governence-India-Spectrum/dp/8124114862">amazon</a>, <a href="http://www.flipkart.com/corruption-corporate-goverance-india-subramanian-book-8124114862">Flipkart</a>), I have said, these three words should be redefined as <em>satyam, spectrum and scoundrels</em>.</p>
<p>This lecture will be in 3 parts:</p>
<ol>
<li>Define what is meant by corruption &#8211; define it as per law on formal basis. Corruption&#8217;s effect and implications</li>
<li>To what extent corporates are engaged in corruption and what they can do to stop it.</li>
<li>Over all cure for the epidemic of corruption.</li>
</ol>
<p>Definition is needed because people call, dowry, extortion, fraud etc. as corruption. Corruption under law is misuse of public office for private gain either for oneself or for one&#8217;s family or for one&#8217;s friends. Prevention of Corruption Act defines it that way. An individual cheating another individual is not corruption. Its pure crime.</p>
<p>Corruption happens when trust is placed on person to occupy public office and nation&#8217;s resources are on the person&#8217;s command and then the person misuses that position for gaining wealth. Prevention of Corruption Act is a criminal law. We can prosecute someone for corruption under criminal law. The Prevention of Corruption Act was first enacted in 1947 and then subsequently in 1988 when new act was brought. There are many things in it that empower Indians to fight corruption. I find that even judges do not know some of the clauses. For instance, when I went to file criminal complaint against A Raja in the specially designated court which is loosely called CBI court, I made a prayer that I be appointed as public prosecutor in this case as I cant trust CBI public prosectutor to perform his role and it will take for ever as they will elongate it. I can help take it to quick conclusion.</p>
<p>The Judge first said, how can I appoint you as public prosecutor as public prosector is an advocate appointed by the government. I pointed out to him that under Section 5 of prevention of corruption of act, anyone that files a corruption case is entitled to be appointed public prosecutor. Judge said &#8220;He had not heard of law and can you read it out to me and if there is any judgement in this regard&#8221;. I read it out to him and  said that in 1984, there is a supreme court constitutional bench judgemen which says Speciality of Prevention of Corruption Act is that individuals can be appointed Public Prosectors. Finally he said my criminal complaint is valid but he also said that as a complainant I had some responsibilities and when that is over, he will consider appointing me as a public prosecutor and it will be known on 5 February. There is lot of panic in lot of circles because once I am appointed public prosecutor, CBI has to assist me and I will start prying about various things. If I am appointed public prosecutor, In the 2G matter, Raja&#8217;ll go to jail within four months. that is what is necessary today. Wide spread impression in the country is people are not sent to jail for corruption. Noone is prosecuted to finality. That mood has to change by one person being prosecuted and then sent to jail. (<strong>Editor:</strong> <em>Events forced Kapil Sibal, Man Mohan Singh and even the fountainhead of Corruption, Sonia to put up a facade of fighting corruption after perpetrating enormous fraud on Indians. CON party is trying to make best of a bad situation. To hoodwink the supreme court, Raja was arrested. The key is <strong><span style="text-decoration:underline;">successful prosecution</span></strong>, where commitment levels of CON party are rather weak if not absent</em>)</p>
<p>There is a fundamental difference between how US conducts itself on corruption and how India conducts itself. US is not the most honest country in the world. According to Transparency international, US is about 20th. India is far down ~ 90th. Denmark is at the top of the list. There is one difference though. In US they do prosecute successfully and take it to end. Now in 2008 January, almost simultaneously two press conferences were held. One in New York. One in Hyderabad. In Hyderabad, Ramalina Raju said, I have committed a crime, I have fudged accounts &#8211; now imagine his fudging accounts, after price waterhouse &amp; cooper gives a clean chit to Satyam and ironically, <a href="http://abhishek-tiwari.com/2009/01/krishna-palepu-should-quite-from.html">an Indian Professor for &#8216;Ethics in Corporate Accounting&#8217;  was an independent member of Board</a> in Ramalinga Raju&#8217;s Satyam; I dont know with what face he can teach students now on the efficacy of his learning. Anyway, Ramalinga Raju said, I am guilty. Around the same time,<a href="http://en.wikipedia.org/wiki/Madoff_investment_scandal"> Bernard Maddof in New York held a press conference</a> and said I have cheated people of their pension funds through Ponzy scheme. He also confessed. In July 2008, six months later, he was sentenced to prison for 150 yrs. This was because there were many charges against him. And they were considered consecutively and that added to 150 years. Ramalinga Raju of course is still in air conditioned hospitals <em>waiting for charge sheet to be filed</em>. That is the difference between India and US. Both are Democractic countries.</p>
<p>People compare India with china and argue how fast it is. People get death sentence etc for corruption. In China people get death sentence only if they are against the government. If people are pro-government, they tend to get away with corruption. I wont consider china as a model. We should benchmark ourselves with other democratic countries and see what is the difference.</p>
<p>It is my belief, even if probablity of catching someone is small. Punish the corupt by the most drastic way possible. Then, it can be shown mathematically as I have done it in my book using the theory of probability that there will be an incentive for honesty (fear of punishment as a deterrent) . Even if the probability of getting caught is low if the punishment is high &#8211; corruption will go down. There in lies the cure and I will talk about it towards end on how to do it. <strong>Important thing is that there is a criminal law in India that if individuals read and understand it, anyone can be caught. Anyone can go to court and file a case.</strong> You must have the stomach to fight it if you are threatened as happened to sonewala or to these RTI people; risks are there. If too many people stand up, there is nothing corrupt can do. That is why I say there shud be a mass upsurge for this. People should educate themselves.</p>
<p>Supreme Court in 1997, propounded Doctrine of Public Trust &#8211; That is betraying public, after having won the trust; they give the example of Satish Sharma handing petrol pumps to a favored few, SC cancelled all of them. I am using that to ask that all 2G licenses be cancelled. Today, I noticed that Kapil is <em>thinking</em> of cancelling. Before we cancel his appointment he is going to cancel licenses. He got such a rebuke last time, he apears a bit chastened. <strong>If law of judgements are understood by reading public, middle class, it empowers individual to fight corruptin. People can take on anyone.</strong></p>
<p>I have done this for a long time. Ramakrishna Hegde was portrayed as an angel because he was talking of value based politics. I found out that he had taken land around Bengaluru, given to his son-in-law. I filed a case at him. I also found out that he was tapping phones including that of his girl friends to find out who they were going along with. That ended RK Hegde career. At that time many were critical as both of us were in janata party and I was doing this to my own party.</p>
<p>Later on I got sanction to prosecute J Jayalalithaa. I was able to send her to jail on custodial interrorgaton basis. By then Muthuvelu Karnunanidhi came to power. He was more corrupt than her. He took all cases away from me by passing a legislation in assemby where-in all cases where Tamil Nadu Govt had 1st fled an FIR, prosection will be done by Government public prosecutor and he backdated FIRs to predate my complaint. Those cases are still going on. Some of them got transferred to Karnataka. One of the cases is reaching judgement stage. There is a danger to J  Jayalalithaa there. But then we had to fight Karunanidhi in election. J Jayalalithaa came to meet me and said &#8220;You may not like me, but we can fight karunanidhi together&#8221;. I said, &#8220;I will not withdraw the case&#8221;. She agreed to it. Then there was a huge propaganda that till yesterday you were prosecuting her, today you have joined her. It becomes difficult to be a purist in this environment. I have to do guerrilla warfare. Sometimes I have to make these adjustments. On the fundamental issue though, I think there is no compromise possible for corruption.</p>
<p>Chanakya had written on corruption. He said there are forty ways to do corruption. Today there are 40,000 ways of doing it. No of ways, ramifications are very very large. Incentive to do corruption is when people want stuff they are not entitled to on merit. Therefore corrupt fellows bribe people that do the allocation and change merit. It ruins the entire society. When u get something that you dont deserve on merit, the decision leads to <strong>sub-optimisation.</strong> Tender for building a road is allocated to someone that builds a road through inferior material. Road gets washed away in one monsoon. So society ends up sub-optimising decision making. (<strong>Editor</strong>. <strong>Corollary is that reservation is a sub-optimization solution too. Bloggers like @realitycheckind that write on Social Justice may want to comment</strong>)</p>
<p>Secondly, in the process, when people  start engaging in corruption, money that comes in tend to be black money. People can invest black money but there is a risk of getting caught. So what do ppl do; they spend on luxury goods, they air condition each room in their home, they buy Mercedes, they go to 5 star hotels for dinner and lunches. In the process corruption distorts <strong>investment priority</strong>. Businessmen would fund those industries where rate of return on investment go up through corruption. If corruption continues, in the future, businessmen will leave producing those that are essential&#8230;clothes, housing&#8230;for common man. They move towards high end returns enabled by corruption. So corruption alters priorities. (<em>Editor: Corruption also enables hoarding. Corruption money also subverts both electoral and political process</em>)</p>
<p>When one makes lot of black money, they have to put it in Swiss Banks. Now not so much in Switzerland. But in Cayman Islands, Macau in China, because they are seen as more trust-worthy. When this money is put in secret accounts, they dont attract interest returns. In fact it attracts service charge. So Indian politicians were thinking how to make the money on the money that they have made. If  they were to pay sevice charge, it reduces the amount they have deposited. So they changed policy by which they can make money on corrupt money. Mr Chidambaram as Finance Minister got a Financial Derivative called<strong> Participatory Note</strong>. No where in the world there is something called a participatory note.</p>
<p>What is a participatory note? You have cash abroad. Or if you have ruppees, take it to a hawala man, he will give u dollars abroad. You take the cash, go to the counter of Morgan and Stanley or Fidelity Investments and say you need a participatory note. He will give you a piece of paper with amount written with nothing else writen on it. Then you go to Mauratius and create a 1$ company. This is thanks to Yashwant Sinha as FM, who had declared that any trading done by companies based out of Mauratius will not be subject to capital gains tax. So you dont have to declare sources of money. SEBI was exempted from surveillance of participatory notes. Short Term Money in stock market has grown up by leaps and bounds in the last 4-5 yrs. The money can come in any time, go out any time. That is also part of law in India now. Participatory Note can be converted back any time. Go to RBI, give the Participatory Note, take the money. Go and buy stocks. Stocks zoom up. Sell the stocks, get the money in dollars and take them out. This is why stock markets oscillate. Indian stock market hs become rigged because of corruption. (<strong>Editor: Tweeple @suchetadalal has extensively covered this in moneylife.in </strong>)</p>
<p>Now there is another important angle. <strong>National Security</strong>: This pertains to 2G spectrum. Two real estate companies &#8211; Swan Telecom and Unitech, were favored by A Raja. They were not telecom companies. They had no telecom experience. They were pure real estate companies. These two companies after getting licenses at ridiculous prices of 2001, went out and sold it to  two foreign companies &#8211; one is called Etisalat and other is called Telenor. In India Etisalat is now called Etisalat-DB (DB is short for dynamics balwas) and Telenor is called Uninor (unitech+telenor). Now that is interesting is they sold licenses to these two companies at 8 times price they paid to govt. When Kapil sibal said there is no loss at all, how come they are able to sell at 8 times the price they paid. Multiply 2001 prices by 8. 14000 cr * 8 = 112000 Cr. CAG added loss accrued on CDMA, Wimax etc and the loss added up to over Rs. 172,000 Cr.</p>
<p>I was in TN village. Villager asked me can you tell me how many zeros are there in 2G scam. I told 11 zeros. People have become excited about this. Many people have asked me what is this 1G, 2G&#8230;Someone asked Manmohan Singh what is 2G. He said..Yes, Sonia G and Rahul G. But 2G  has got to do with number of cycles per second. When I use a cordless phone land line the wave is long. No of cycles is more in 2G. You can send more information. Similarly 3G, 4G number of cycles are even more. That is physics. G is generation.</p>
<p>During the spectrum sales process, Home Ministry kept quiet. Home Ministry in another context had written a letter to Finance ministry and to RBI that as far as Etisalat and Telenor are concerned they are undesierable from national security point of view. Why? Home Ministry said, Etisalat is controlled by ISI of Pakistan. I checked Etisalat website and they themselves acknowledge that 27% of Etisalat is controlled by Government of Pakistan. Home Minstry goes one step further and says that one of the Etisalat directors is a close associate of Dawood Ibrahim.</p>
<p>Telenor buys equipment from the Chinese People Liberation Army. Telenor has developed a software by which anyone that uses Telenor SIM card can be tracked any time, any where. PM may not carry this phone. His PAs, his peons, his drivers, end up carrying Telenor. Then if necessary they can be tracked by Telenor. They are going to put up towers.These towers can hear other people&#8221;s conversations. Now, in US, they dont allow foreign companies to do all this. Their country is supposed to be a free capitalist country. This is because National security is involved. Here it has been sacrificed because of the money that has been made. I am saying that corruption completely undermines values to the point where even national interests are sacrifiecd. That is why it is dangerous.</p>
<p>I dont need to tell u about <strong>Corporates (corporate corruption).</strong> I can tell u one story abut how a corporate came up through corruption. In 2001, I was invited by (New York Stock Exchange) NYSE Board to give lecture on corporate governance. I spoke about disclosure norms of Securities Exchange Commission (SEC). These came up because of Enron. <a href="http://en.wikipedia.org/wiki/Jeffrey_Skilling#Indictment_and_trial">Enron had parallel accounting</a>. That means they showed profits that did not exist and the stock went up. One day, enron could not make debt payment; the fudging had gone far. Then there were new SEC disclosure norms.<strong> I pointed out to them and said if these norms are applied, most of the top companies in India will become disqualified.</strong></p>
<p>I pointed out about a company that had put a Rs. 3000 Cr IPO to build a Petrochemical Complex in Gujarat. After it got Rs. 3000 cr, it wrote to Govt, saying there is going to be a delay and the company should be allowed to give the money as inter-corporate loans to other companies. Govt gave permission. The company had tremendous influence. I tracked that. I noticed that 253 companies got inter-corporate loans. I got someone to do research with Registrar of Companies. All the 253 companies had the same chairman, same directors and same address also. And therefore I went to the address. I found one small locked room in Maker bhavan with no furniture in it. Now What did these companies do after getting the intercorporate loans? They went back and purchased the stock of the company that gave them loan in the 1st place! And this clever person took another loan from bank by hypothecating the inflated value of the stock. I will call this as more than corruption. I will call this fraud. When I told this to NYSE board, the board members started giggling and one of them asked if I brought this to the attention of authorities. I told him that I have filed a case in the Delhi high court. HC has issued notice. There after High Court sent it to Ministry of Corporate Affairs, Company Law Board to give a status report. That was in 2001. Company Law Board is yet to give a status report. I am in no hurry. One of these days, when I have spare time, I will go back to Delhi High Court and start making ruckus. Right now bigger things are going on. Then the board asked me if I can send details. I sent them that. At that time 12 companies had applied to be listed in NYSE. Company I mentioned ceased to qualify. Remaining 11 qualified and one of them was Satyam. At that time, I did not think Satyam would do all this. I thought, Satyam would mean <em>Satyam</em>..it was not so!</p>
<p>Mr. Holla  says corporates should reduce 50% bribe amount that they pay to get work done. I would ask corporates to flatly say, no bribes. <strong>But it should be a collective effort</strong>. If u wont pay and if another fellow says he would then get the contract. You all know who is corrupt and who is asking how much.You shoud inform this. Spread the news.</p>
<p>40% of Indian GDP is in foreign hands. Its not difficult to get the money back. But the current lot would not do it because many in power have accounts. Germans gave half a billion dollars to an employee of a Lichtenstein bank &#8211; said, give us all the secret accounts. About 300 accounts details were given to them. Many are Germans and they have been prosecuted. Germans then wrote to various countries &#8211; &#8220;We are ready to share it&#8221;. In 2008, I corresponded with Manmohan Singh. I asked the PM, what are you doing about it. After much prodding he acted; but he is refusing to release the names. Because one of his top minister&#8217;s son&#8217;s names is believed to be there in one of the accounts. One top industrialist&#8217;s name is also there in the account. This is only for a small country like Lichtenstein. Imagine what it will be for Switzerland.</p>
<p>One of my students at Harvard is in Switzerland. I still teach every year a semester in Summer. My student is holding a key position in a bank in Zurich. He told me that there is a law in Switzerland by which GoI can get all the information if they so want. GoI should issue an ordinance, if they want to get the details quickly. The ordinance should declare that all accounts  by Indian passport holders in Switzerland are here by nationalized; and if any of those account holders prove to us that the money held in Switzerland is legitimate, we will de-nationalize that account. all others will be Govt property. Switzerland will be compelled to execute that as they cant have illegal accounts. PM of course cant do anything today.</p>
<p>You will ask me why did you save PM in the Supreme Court. I say, what is the use of making him resign. Another person will come. At least this person is spineless honest person. Next person will be corrupt spineless person. If the whole Govt goes out then there is no problem. But why him alone. Everyone is angry with MMS. Everyone knew about him. He did not come through elections. He is not even an MP. This much is said about him that he is a man of personal integrity. But personal integrity is not enough. Bhishmacharya had great personal integrity. But he watched Draupadi being stripped in front of everybody. Shri Krishna decided he deserves to die. But then when he died, the whole Kaurava camp went with him. If the whole UPA govt is going to be removed, I will be the first one to say, MMS led Govt for God&#8217;s sake should go.</p>
<p>Corruption should not be a party matter at all. Take some measures. Some of them short term. Some of them long term. Let me say some sectors were very corrupt and today are relatively honest. Railway reservation. In 1970s, it was hell to get train reservation. Rajiv Gandhi among the good things he did was bring in the computerization of railway reservation. Today by and large there is no corruption. So corruption was eliminated in Railways by eliminating discretion. Something like the spectrum, you cant have waves colliding. So spectrum like land is a scare resource. Whenever you have a scarce resource, auction is the way. Make that law; then scope for corruption gets reduced. 2G corruption took place because auction was avoided. Noone talks about corruption in 3G because 3G was auctioned. We got lakh of crores there.</p>
<p>We need to make an example of few people. Keep focusing. I am focussing today on Raja. After I am finished with Raja, I will go after the Rani (<em>Sonia G</em>) also. Because he got only 10% of total bribes. Total bribes were 35% of loss which is about Rs. 60,000 Crores. 10% of that is only Rs. 6,000 Cr. Its not big these days. Only 10 yrs ago, I have seen raja come on cycle. Other people got a bigger share. <strong>Who provided him patronage</strong>. Today A Raja is feeling let down. Today safest place for him is jail. If other people feel he can spill the beans he wont see the next day. He might get a <em>mitai (sweet)</em> which will make sure he does not see the next day. Thefore, I will say, we have to make an example. Take one case..forget IPL, forget commonwealth. One minster has to be punished.</p>
<p>Second thing is why is there so much corruption after liberalization. I am not sure. During permit license quota raj too there was much corruption. Numbers today are much larger. Our economy is also much larger today. <strong>One thing is corruption is an outcome of greed</strong>. Someone said it. With Greed there is no saturation. It is like putting Ghee on fire. So more money you make, you want to make further. Greed has come because of materialistic outlook we have developed.<em> This is not <a href="http://zoomindianmedia.wordpress.com/2009/08/01/what-is-dharma-for-a-hindu/">sanatana dharma</a> (India&#8217;s native tradition)</em>. All through Indian civilization of thousands of years, one thing was always stressed. Material growth is essential &#8211; but it has to be harmonized with spiritual values. That is why when 2 great Rishis, Brighu, Bharadwaj got together and decided to structure society, they set up a Varna system which got degenerated because it got connected with birth.</p>
<p>In the original varna system of Brghu, Bharadwaj it had nothing to do with birth. You can see it for yourself. Veda Vyasa who wrote Mahabharat was born to a fisherwoman. He was not a Brahmin. Valmiki was from most backward or dalit class. He was a Maharishi. Viswamitra who was Rshi of Rshis &#8211; his parents were Kshatriyas. Kalidasa, Kavi of Kavis was born to Hunters. Yes. Ravan was a brahmin.And he was killed by a Kshatriya. Rama. All the Brahmins worship Rama. they dont say, this man worshipped one of our own people. I explained this to Karunanidhi. He was all the time presenting Ravan as a dravidian god. He does not do it any more; As I brought out the Ramayana and showed him that Ravan was a Brahmin. Nowadays, he only attacks Rama. One day he attacked Ramasetu. How can u call it by that name. Was it built by Rama? Was he an engineer? Which college did he go to? Next few days he fell ill. He was admitted to a hospital with the name, Ramachandra Medical hospital. I wrote to him and sent a &#8216;Get well soon&#8217; card and wrote when did Rama get MBBS?</p>
<p>In our system, Acharyas could be from any caste. But they had to have knowledge. They cud not have weapons. they could not have wealth. They had to beg for food. But the society held them in high esteem. The king, the Kshatriya, he had the weapons. He could not decide by himself, if he could go to war. He had to ask for permission from Brahmins. He could not mete out arbitrary punishments. We were not a monarchy in the western sense. Its wrong to call India a monarchy. Vaishyas could make money. But their social status was not proportional to the amount of money they had. Similarly Shudras &#8211; they had land; but they had to produce for society. Those pushed out by society, their children were not outcasted. That was the original system. Krishna says this in Gita &#8211; it has nothing to do with birth. It has to do with Gunas (inherent qualities).</p>
<p>Anyway today it is a discredited institution. We have to act as one people. And we are one people because, the DNA analysis now shows, that we are all one ppl. This dravidian/aryan divide is bumkum; no truth in it. Fundamentally we are one and a continuing society.</p>
<p>(<strong>Editor: Jati and Varna are systems that have been dynamic systems. These are distinct from what the westerners call caste. MN Srinivas has written on the enormous resilience of Jati, and its dynamic nature. Right leveraging of strengths of varna, jati paradigms and institutions for social good should be attempted rather than accentuate jati for manufacturing hate towards the &#8216;other&#8217; as happens in current sickular polity. It is no coincidence that backers of corruption and sickular polity are one and the same. By dividing Indian people through divisive rhetoric, by condoning violence by certain groups, by encouraging identity politics and not aspirational politics, sickular politics nurture, hate and divisiveness for the benefit of sickular organisations.</strong>)</p>
<p>US is a rich country. Now you find that increasingly people take to Hinduism. Julia Roberts with her entire family converted to Hinduism. Now there is a book called American Veda. It says American peoople are fascinated by Hindu religion bcoz, there is no greed. There is no one view. You can believe in God; you can not believe in God. There are some <a href="http://zoomindianmedia.wordpress.com/2009/08/01/what-is-dharma-for-a-hindu/">fundamentals &#8211; that are rational (not dogmatic)</a>. Sri Sri Ravishankar ashram is full of foreigners. Swami Dayanand Saraswati Ashram is full of foreigners. When I go to Harvard to teach, people see my name Swamy and think I am a sadhu. People ask what can they do for mental peace and happiness. Unless material wealth is balanced with spiritual values, you are going to be an unhappy country. Pure materialistic approach is the reason for corruption. Long term solution to corruption is going back and bringing back values of simplicity, venerating people that give up everything. This globalisation&#8230;make more money, any short cut..that has to change in the long run.</p>
<p>I am 100% certain, India cant be called dead country in terms of emotions. whenever there is a crisis, this country has stood up. 1962, chinese honestly thought, one little blow, country will break into 20 pieaces. The Chinese leaders themselves told me this. They were surprised when the country rallied. Women sold gold bangles for national defence funds. 1977, who thought Indira Gandhi will be defeated. Entire nation rallied. When Indira Gandhi was assassinated in 1984, nation again was together. I am almost certain on corruption there is that kind of consensus. Country is ready for major change. So instead of spreading gloom that nothing is goin g to happen, which I think, Congress party people are doing, something must and will happen. This atmosphere of hope and optimism must be spread as foundation for attacking corruption.</p>

<p><strong>Q</strong>: Why not we arrange for state funded elections, to break the corrupt nexus between corporates and politicians.</p>
<p>A: State funding is not the solution. Voting the right candidate is the answer. Mrs. Gandhi distributed sacks of money in 1977 for her election in Rai Bareli and she lost miserably. In 1997, J Jayalalithaa lost in Bargur despite doles of gold ear-rings distributed inside a ladu. And she lost against a tea stall owner. Cynicism pervading the country is a reason for widespread corruption.</p>
<p><strong>Q</strong>: Why don’t independents win elections?</p>
<p>A: First thing would be to mobilize support for such candidates but we seldom do that. There is no public participation unlike the US where there is good public participation during elections. People seem to think that every candidate has to be come to everyone&#8217;s home like a cabaret dancer. It’s a debilitating view to vote with the flow for a winning party. Political careers of honest candidates are destroyed. This attitude has to change. Political parties will put up good candidates if they know that they will win. Political parties will change by the market.</p>
<p><strong>Q</strong>: Do you think, if we had adopted market economy instead of socialism we would have had less corruption and been more democratic? you have vehemently stood for market economy since 1969 onwards. You even wrote a book on that. Do you think corruption wuld have come down as it is more de-centralised and democratic compared to socialism which gives complete power to  government and harassment to public or corporates where they depend on Government for everything.</p>
<p>A: 1947 there was a wave of enthusiasm. Lot of good people came to politics. Following the soviet model led to license raj, which led to corruption &#8211; selling of permits, quotas, licenses. If we had adopted market economy, not laissez faire as wished by our founding fathers, Gandhiji, Rajendra Prasad and Sardar Patel we would have been in a much better position. You see the comparison (market economy, soviet model). Take the examples of S.Korea versus N .Korea or W.Germany versus E.Germany, China/India of today and before. I once discussed this with EMS Namboodripad, Marxist Communist party head. In capitalist country there is only crisis. In Soviet Union there is no corruption, no inflation etc. After few years I met him and told him, now there is no soviet union also. It has broken to 16 countries!                (<strong>Editor: <a href="http://intellibriefs.com/mitrokhin.pdf">Communists in India have a history of being bribed by foreign elements</a>. That in various forms continues till date though many have become sophisticated and migrated to wear liberal/internationalist masks</strong>)</p>
<p><strong>Q</strong>: Who can eradicate corruption?</p>
<p>A: Pls dont think of Bhagavad Gita <em>Yada Yada Hi Dharmasya, Glanir Bhavati Bharata </em>out of context. You are there. You elect good people. Change will come. Politicians think only way to win is by giving money and buy loyalty. That psycholgy in politicians can be changed only by people.</p>
<p><strong>Q</strong>: When can we have 50 Subramanian Swamys?</p>
<p>A: Well cloning is possible. <em>(More seriously)</em> I remember someone asking Mahatma Gandhi what makes you different. He replied, &#8216;my courage&#8217;. And the American reporter went on &#8220;Can everyone become Mahatma Gandhi&#8221;? &#8220;Yes&#8221; replied Gandhi if &#8216;people can manifest the same courage, not being afraid of anything including of dying&#8217;.</p>
<p><strong>Q</strong>: What are your opinion on Karnataka?</p>
<p>A: For a person who has seen happenings in Delhi, Yeddyurappas digressions look like small traffic offence.</p>
<p><strong>Q</strong>: CBI is Congress Bureau of Investigation. It has to become an independent entity. Central Vigilance Commision, Lok Ayuktha should be independent. If these three are made independent and a bill is passed in parliament, it should be brought into execution.</p>
<p>A: They need to be made indepenedent with provisions for appointing an independent prosecutor like in US. Lok Ayuktha can only recommend action. It should have prosecution powers.</p>
<p><strong>Q</strong>: On a weak judicial system in India. No actions from Arun Jaitley, Veerapa Moily to strengthen Judicial System.</p>
<p>A: Law should be a curriculum in India in schools. Women should be thought karate, men should be thought the law. People don’t believe in lawyers.</p>
<p><strong>Q</strong>: Laws are complicated and bureaucracy adds to the same. System has become bad. We need a benevolent dictator.</p>
<p>A: There is no such thing as benevolent dictator just like there is no boiled ice-cream.</p>
<p><strong>Q</strong>: People have lost faith in 3 pillars of democracy &#8211; exec, legis, judiciary. Judiciary also seems to be suspicious. How to get rid of it?</p>
<p>A: Don’t agree with that hypothesis. I have been receiving lot of material to fight corruption from nameless bureacrats who themselves cannot take on the system. Value system is surviving. It has to be bolstered. Public perception is resulting in Judicial actions. People like you have to create a positive view.</p>
<p><strong>Q</strong>: Corruption in media….</p>
<p>A: Biggest expose of 2G by J Gopikrishnan of Pioneer. He is a simple person. He could have got 1000 crores from Raja. He laid foundation for us to go to court. Some of the prominent journalist people. Niira Radia has brought it out. Everyone in any line is not corrupt. I would say 75% politicians are non-corrupt, but they keep quiet for their party bosses fund their elections. Such Blanket association is hence wrong.</p>
<p><strong>Q</strong>: what are your chances of being public prosecutor on 2G scam?</p>
<p>A: We ll know soon.  I will be appearing in court on Feb 5<sup>th</sup></p>

			<content:encoded><![CDATA[<p>India&#8217;s self styled national newspaper &#8216;The Hindu&#8217; reported a news that was all fire and brimstone at the recent Supreme Court Judgement rejecting CBI&#8217;s appeal for death sentence at him.</p>
<p>The news was written by a &#8216;Special Correspondent&#8217;. It said “Expunge remarks against Graham Staines” referred to &#8220;Editors&#8221;, &#8220;civil society&#8221; Court remarks as “gratuitous” and “unconstitutional&#8221;.  <em>In India by the way self certified &#8216;civil society&#8217; and &#8216;editors&#8217; are perceived by educated people as swear words considering the long history of media deceit that includes the recent Radia tapes release</em>.</p>
<p>News was remarkable as it was an open defiance, contempt of highest judicial authority in the country, Supreme Court of India.</p>
<p>What is intriguing was that later in the day, the paper backed off. It retracted news. The retraction withdrew the &#8216;media backing&#8217; to the self styled &#8216;civil soceity&#8217;. It was signed by editor-in-chief and cited inexplicable mistake by the special correspondent.</p>
<p>Citizens would like to know the truth on <strong>who was the special correspondent</strong>? The article even had the photo of smiling graham staines family by way of &#8216;special arrangement&#8217;. We would like to believe that the original piece was not a trial baloon to gauge <a href="http://zoomindianmedia.posterous.com/dara-singh-sickular-spin-doctoring-unplugged">reaction</a>. The newspaper should come clean on who the special correspondent was as the editor-in-chief himself admitted that the act by special correspondent was a<strong> serious blunder</strong>.</p>
<p>Citizens have a right to know if the serious blunder was motivated by sickular idealogical corruption rampant in &#8216;The Hindu&#8217; newspaper. <span id="more-1116"></span></p>

Main reason for this corruption is control of media by those whose agenda is anti-native. This results in dangerous subversion. What people watch as news is faked reality, carefully calibrated. Sickular agenda effectively <a href="http://zoomindianmedia.posterous.com/ndtv-sickular-news-model">contorts</a> what Indian people see as news. Rise of internet has broken the media oligopoly. Thanks to the online efforts of bloggers &amp; tweeple, now more &amp; more Indians are getting a peep into reality.</p>
<p>This empowerment of Indian people among others was celebrated by Amitabh Bachchan, Bollywood Icon. Amitabh <a href="http://www.twitlonger.com/show/887lem">cited</a> a recent article in DNA written by tweeple @Rajeevsrinivasa. Rajeev&#8217;s artcile specifically commends the work of tweeple @swathipradeep2 @barbarindian @preeti86 @sandeepweb and @atanudey for their work in de-mystifying sickular canards and exposing deceit. Now #barkhagate, #chormedia, #ibnlies, #mediamafia #radiamedia are part of lexicon.</p>
<p>Yesterday was an important day for Indians. A day when 21 years of Kashmiri Hindu ethnic cleansing by islamists got completed. It was a unique event in the annals of history. Hundreds of Thousands of Kashmiri Hindus, native people of Kashmir, were driven out through coercive threats. State government apparatus failed.  In the true traditions of islamist sickular discourse, the Hindu victims were blamed for their victimhood, a canard <a href="http://www.indianexpress.com/news/i-did-my-best-to-stem-the-exodus/737340/0">disabused</a> by Governor of the state in 1990, Shri Jagmohan. Government apparatus</p>
<p>Indian Government propagating rogue notions of sickularism failed to provide security to Hindu people. Supreme Court was <a href="http://timesofindia.indiatimes.com/india/SC-criticises-Omar-Abdullah-govt-over-migrants-issue/articleshow/7303297.cms">appalled</a> this week that the Govt provides only verbal commitments and no concrete relief to Kashmiri Hindus.</p>
<p>Native Indian people discussed online ethnic cleansing of Hindu people in Kashmir. They even made this major onlne trends while organized sickular media mafia was muted and provided hardly any coverage on the event.</p>

<p>Dichotomy of the coverage was not lost on discredited journo, Barkha Dutt, NDTV editor, one of the most sinister media journalists. Barkha Dutt last year was caught on tape, lobbying Telecom Ministership for A Raja, a corrupt minister who was responsible for loot to the tune of Rs. 1,76,000 Crore from spectrum, a national asset and which essentially is asset of each Indian.</p>
<p>Barkha Dutt ended up rationalising ethnic cleansing of Hindus by refering to what she called &#8216;genuine differences&#8217;. Probably it was a freudean sickular slip to hide the role of islamist terror in Hindu ethnic cleansing in Kashmir. Indian people know how the ethnic cleansing was organized by islamic elements. Please see this <a href="http://is.gd/uEN0L2">Video</a> at 1:29 and onwards. Certified by Sickulars as &#8216;moderate muslim&#8217;, Benazir Bhutto manifested &#8216;genuine (<em>sickular?</em>) differences&#8217; that would have made Maulana Maududi proud and enabled islamic hate &amp; encouraged ethnic cleansing of Hindus.</p>
<p>Unfortunately for Barkha, her online nemesis <strong>Swathi Pradeep, Blogger &amp; Chief Editor Citizen Journos</strong> saw Barkha Dutt&#8217;s stupefying rationale. She called Barkha Dutt&#8217;s bluff.</p>

<p>Other tweeple too did not find Barkha Dutt&#8217;s blatant sickular rationalisation of Kashmiri Hindu ethnic cleansing funny. Even Pakistan&#8217;s commentator Marvi Sirmed tweeted &#8220;Any act of killing people for being from a particular religion, is a communal act. Where&#8217;s the ambiguity?&#8221;</p>

<p>It is time Media deceits realized that tightly controlled oligopoly environ when media could get away with deceit and lies are gone for good.</p>
<p>For Indians lessons from Kashmir is<a href="http://zoomindianmedia.wordpress.com/2011/01/19/kashmiri-hindus-enter-22nd-year-of-exile/"> clear</a>. Not to be fooled by slogans like secularism, peddled by groups with subversive agenda. Sickularist deceit has to be exposed every time. Secularism is undesirable in the context of native <a href="http://zoomindianmedia.wordpress.com/2009/08/01/what-is-dharma-for-a-hindu/">Dharma</a>. Secularism has utility when it is applied to isai and perhaps islamic institutions; as secularism as a paradigm was contextual and was developed in the west as an answer to the tyranny of dogmatic christianity.</p>

			<content:encoded><![CDATA[<p>300 years ago, when islamists carried out their adharmic islamic project to convert native <strong><em>Bharatiya</em></strong> in Kashmir, natives had the wherewithal to resist. They could then very clearly see that Aurganzeb was foisting Adharma and they had to take a stand for <a href="http://zoomindianmedia.wordpress.com/2009/08/01/what-is-dharma-for-a-hindu/">Dharma</a>.</p>
<p>Today because of the propagation of adharmic concept of sickularism which essentially is a cover for totalitarian (isai-islami-laal) dogmas based fascism, natives have not been able to bear the brunt of this evil.</p>
<p>Original natives of Kashmir were forced out by islamic Gun and the Indian state at best has provided only lip service. BJP offers sympathetic ears. CON party is reluctant to even offer that.</p>

<p style="text-align:left;">What can Kashmiri Hindus do. They have faced the brunt of islamic hate.</p>
<ol>
<li>Dont buy lip sympathy to your ethnic cleansing. Ask the &#8216;so what&#8217; question to those that proffer lip sympathy? Ask what have you done to  de-legitimatise sickularism, islamic dogma responsible for your plight? Ask what have you done to amend articles 25 to 30 in Indian Constitution that enable sickular hate and create an environment for subjugation of Bharatiya?</li>
<li>There will be those that will tell you, dont peddle victimhood and move on, a sermon sickulars would never make to isai or islami. Tell them that reclaiming your dignity and space is not victim-hood. Dont get conned by multiple layers of deception woven around sickular narrative. Call it out for what sickularism is &#8211; clear and present evil.</li>
<li>Dont expect some great hero will come out and fix your problems without effort from your side. This is a mistake many Indians do and has to be avoided. And face it <em>Bharatiya</em> are friendless. Most of the so called secular/humanitarian organizations have an agenda and unlikely to go beyond offering lip sympathy. Ditto for sickular controlled media. Challenge for Bharatiya remains organizing themselves for their own welfare and Dharma&#8217;s wellbeing.</li>
</ol>
<p style="text-align:left;">If Indians had learnt the right lessons from partition, Kashmir would not have happened. Sickularism ensured that in less than 2 generations time (1947-1989), ethnic cleaning happened in Kashmir. Ethnic cleaning of natives would happen again and again unless natives do not call out the sickular bluff; recognize &amp; undermine desert dogmas for what they are &#8211; intolerant hate towards non-believers. It is incumbent on anyone who is <em>Bharatiya</em> and cares for Dharma to take a stance against sickularism.</p>
